ASH reserves the right to change modify add or delete portions of these terms and conditions at any time. Your continued use of this web site following any such changes constitutes your acceptance of the User Agreement as modified. Please refer to the date listed above to determine when the last changes were made. For certain ASH products ASHLink may be used to access ASH’s Virtual Platforms. When accessing the Virtual Platform through ASHLink the Virtual Platform Terms and Conditions apply.

ASH does not make any warranty express or implied or assume any legal liability or responsibility for the completeness or usefulness or the accuracy or quality of any information presented on the ASH website. While reasonable efforts have been made to ensure the accuracy of the information provided the information is subject to change without notice and cannot be guaranteed to be current.
3. COPYRIGHT. All content of the ASHLink web site is copyrighted. You may download material displayed on this web site for noncommercial; personal use only provided you also retain all copyright and other proprietary notices contained on the materials. You may not however distribute modify transmit reuse repost transfer or use any content or information of the website for public or commercial purposes without ASH’s prior written permission.

ASHLink complies with all applicable state and federal laws pertaining to the collection use and disclosure of personal information obtained through the ASHLink website. ASHLink’s privacy and security practices are also governed by the provisions of each Practitioner’s Service Agreement with the applicable American Specialty Health affiliate.

6. AUTHORIZED ACCESS. The ASHLink website is an online resource for authorized users to verify eligibility access online materials and submit electronic transactions directly to ASH. ASHLink does not offer medical advice. ASHLink is owned and operated by ASH and is a resource provided for the exclusive use of authorized registered users who must be: (1) A current participating Practitioner in good standing with ASH; or (2) An individual who has been granted access by a current participating Practitioner in good standing with ASH in order to utilize ASHLink on behalf of or in support of that Practitioner.
   
   Access to ASHLink will be provided to eligible Practitioners upon completion of the registration process. The Practitioner is solely responsible for the distribution and management of passwords and access rights needed by others to access ASHLink to conduct business on their behalf.
   
   ASHLink is for the exclusive use of authorized registered users and each individual authorized user may only access ASHLink by using the credentials that were provided to them. Accessing ASHLink using credentials issued to another user is expressly prohibited. Authorized users are prohibited from disclosing or sharing their password or other credentials to access the site. ASH reserves the right to revoke access to ASHLink at any time. By using this site you agree that ASH may monitor your use of this web site and may use results of such monitoring without limitation.
   
   ASH reserves the right to monitor usage of ASHLink and to use passive tracking mechanisms including the use of cookies and the logging of activities performed online. This information is used to monitor site usage identify areas requiring improvement and collect data about transaction volumes. By requesting access to ASHLink you are consenting to allow monitoring for your activities when you access the site.
7. RESPONSES TO MESSAGES. ASHLink’s Message Center provides a mechanism for secure electronic messaging between you and ASH. When you contact us using the “Submit a Comment or Question” form you will receive a response on your ASHLink Message Center page. Response times vary depending on the type of inquiry but all inquiries will be responded to within 10 business days.
8. MINORS. The ASHLink web site is not designed or intended for use by minors. You must be an individual 18 years of age or older to use the ASHLink web site.
9. ADVERTISING AND PROMOTIONS. ASHLink will occasionally feature offers and promotions from external vendors. Your correspondence or business dealings with advertisers or Practitioners of products or services found on or through the ASHLink website including payment and delivery of related goods or services and any other terms conditions warranties or representations associated with such dealings are solely between you and such advertiser or Practitioner. You agree that ASH shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers or Practitioners on ASHLink. ASHLink will not sell or rent specific information about you to advertisers or Practitioners of products for the purpose of marketing.
10. THIRD PARTY LINKS. Third party web sites linked from ASHLink are not under the control of ASH and ASH is not responsible for the content of any linked website or any link contained in a linked web site or any changes or updates to such websites. ASH provides these links to you only as a convenience and the inclusion of any link does not imply a financial or business relationship nor endorsement by ASH of the website or its products or services. ASH is not responsible for any activities that you may engage in on any linked website including without limitation purchase of products or services.
11. GOVERNING LAW. This User Agreement shall be construed governed by and enforced solely and exclusively in accordance with the laws of the State of California without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of this User Agreement to be unenforceable the remainder of the Agreement will continue in full force and effect. You hereby agree that the courts located in the State of California USA will constitute the sole and exclusive forum for the resolution of any and all disputes arising out of or in connection with this Agreement and you hereby consent to the personal jurisdiction and venue of such courts and irrevocably waive any objections there.
12. LIMITATION OF LIABILITY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE ASHLINK WEB SITE AND THE INFORMATION THEREON IS ENTIRELY AT YOUR SOLE RISK. ASH AND ITS AFFILIATES AND LICENSORS WILL NOT BE RESPONSIBLE TO YOU OR TO ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT CONSEQUENTIAL SPECIAL OR PUNITIVE DAMAGES OR LOSSES YOU MAY INCUR IN CONNECTION WITH THE ASHLINK WEB SITE YOUR USE THEREOF OR ANY OF THE INFORMATION DATA OR OTHER MATERIAL TRANSMITTED THROUGH OR RESIDING ON OUR WEB SITE REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS.
